These Terms of Use ("Terms") govern your access to and use of mypromoorder.com (the "Site") and any orders you place through it. The Site is operated by My Promo Order, LLC ("we," "us," or "our"). By using the Site, creating an account, or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
Eligibility
The Site is intended for business use by adults. By using the Site, you confirm that you are at least 18 years old and able to enter into a binding agreement. You agree to use the Site only for lawful purposes.
Your Account
To place orders, you may need to create an account. You agree to provide accurate and complete information and to keep it up to date.
You are responsible for keeping your login credentials secure and for all activity that happens under your account. Tell us right away if you believe your account has been used without your permission. We may suspend or close an account that is misused or that violates these Terms.
Quotes, Orders, and Pricing
Quotes and pricing shown on the Site are estimates based on the details available at the time. Pricing depends on the product, quantity, decoration method, and other factors, and it may change before your order is confirmed.
An order is accepted only when we confirm it. We may decline or cancel an order for reasons that include product availability, pricing errors, artwork problems, or suspected fraud. If we cancel an order you already paid for, we will refund the amount paid for that order.
Artwork and Proof Approval
You are responsible for the artwork, logos, text, and instructions you provide. Before we begin production, we prepare a digital proof for your review. Production starts only after you approve your proof.
By approving a proof, you confirm that the layout, spelling, colors, sizing, and placement are correct. We produce your order based on the approved proof. We are not responsible for errors that were present in a proof you approved.
Rights in Your Artwork
By submitting artwork, logos, or other content for your order, you represent and warrant that you own the rights to that content or have permission to use it, and that producing your items will not infringe the rights of any third party.
You grant us permission to use your content as needed to produce and fulfill your order, including sharing it with suppliers and decorators. You agree to indemnify and hold us harmless from any claim arising out of content you provide, including claims of trademark or copyright infringement.
Custom Products and Cancellations
Our products are custom decorated to your order. Once an order has entered production, all sales are final. Custom decorated items cannot be canceled, returned, or refunded after production begins, because they are made specifically for you and cannot be resold.
You may request to cancel or change an order before it enters production. We will do our best to accommodate the request, but we cannot guarantee changes once proof approval and production are underway. If an order arrives damaged or with a defect on our part, contact us and we will work with you to make it right.
Payment
Payment is due as stated on your quote or order confirmation. We accept the payment methods shown at checkout. Payment card information is handled by a third party payment processor under industry security standards. You authorize us to charge the payment method you provide for the amounts due on your order.
Shipping and Delivery
Shipping and delivery are covered in our Delivery & Shipping Policy, which is part of these Terms. Production and transit timeframes shown on the Site are good faith estimates and are not guaranteed unless we confirm a guaranteed date in writing.
Our Intellectual Property
The Site and its content, including text, graphics, logos, layouts, and software, are owned by us or our licensors and are protected by law. You may not copy, reproduce, or reuse any part of the Site without our written permission. This does not apply to your own artwork and content, which remains yours.
Acceptable Use
You agree not to use the Site to:
- Break any law or infringe the rights of others
- Submit false, misleading, or fraudulent information
- Upload content that is unlawful, infringing, or that you do not have the right to use
- Interfere with the security or operation of the Site
- Attempt to gain unauthorized access to any part of the Site or other accounts
Disclaimers
The Site and our products are provided on an "as is" and "as available" basis. To the fullest extent allowed by law, we disclaim all warranties that are not expressly stated, including implied warranties of merchantability and fitness for a particular purpose. We do not guarantee that the Site will be uninterrupted, error free, or secure.
Limitation of Liability
To the fullest extent allowed by law, we are not liable for any indirect, incidental, special, or consequential damages arising out of your use of the Site or your order. Our total liability for any claim related to an order will not exceed the amount you paid for that order.
Indemnification
You agree to indemnify and hold harmless My Promo Order LLC and its owners, employees, and partners from any claim, loss, or expense, including reasonable legal fees, arising out of your use of the Site, your orders, the content you provide, or your violation of these Terms.
Privacy
Your use of the Site is also governed by our Privacy Policy, which explains how we collect and use your information. Please review it.
Changes to These Terms
We may update these Terms from time to time. When we do, we will change the date at the top of this page. Your continued use of the Site after an update means you accept the revised Terms.
Governing Law
These Terms are governed by the laws of the State of Michigan, without regard to its conflict of law rules. Any dispute arising out of these Terms or your use of the Site will be brought in the state or federal courts located in Oakland County, Michigan, and you consent to the jurisdiction of those courts.
